Abstract

Di era modern sistem pemerintahan Indonesia yang semakin condong ke arah legislative heavy membuat kedudukan Presiden sebagai kepala pemerintahan dipertanyakan, padahal idealnya sistem pemerintahan presidensial menjamin kebebasan kekuasaan eksekutif (Presiden) untuk menangani hal-hal yang tidak dapat dijangkau oleh kekuasaan legislatif. Presiden dinilai tidak dapat menjalankan fungsi dan tugasnya dengan sepenuhnya karena banyak hal yang mengharuskan adanya pertimbangan DPR. Hal tersebut terjadi karena di dalam beberapa pasal undang- undang mengharuskan adanya pertimbangan DPR untuk pengangkatan, dan pemberhentian jabatan pemerintahan tertentu misalnya pengubahan formasi kementerian. Penelitian ini adalah penelitian hukum. Adapun pendekatan masalah yang dipergunakan untuk menjawab isu hukum tersebut adalah Pendekatan perundang- undangan (statute approach), adalah pendekatan dengan menggunakan legislasi dan regulasi. Pendekatan konseptual (conceptual approach) digunakan untuk mengkaji dan menganalisis kerangka pikir, kerangka konsep atau landasan teoritis isu hukum yang akan diteliti, dan pendekatan perbandingan (comparative approach) yaitu pendekatan yang membandingkan dua sistem hukum dari negara yang berbeda. Dari pendekatan ini peneliti dapat menggunakan pisau analisis dalam mencari jawaban atas isu hukum dari penelitian skripsi ini. Berdasarkan analisis bahan hukum yang diperoleh kesimpulannya bahwa pengaturan pemberian pertimbangan DPR tidak sesuai dengan sistem pemerintahan presidensial karena: a. Prinsip check and balances yang diterapkan membatasi kekuasaan Eksekutif Presiden b. Terjadi peleburan kekuasaan akibat pengaturan pemberian pertimbangan DPR c. Adanya supremasi Legislatif bukan supremasi konstitusi. Adapun saran yang dapat diberikan ialah diperlukan adanya undang undang baru yang mengakomodir perubahan terhadap beberapa pasal di dalam Undang Undang Kementerian Negara sehingga menjadi lebih jelas bahwa prinsip check and balances tidak membatasi kekuasaan eksekutif.
