Abstract

Anak merupakan generasi penerus bangsa, sebagai kekuatan terbesar dan potensi untuk melanjutkan masa depan bangsa dan negara. Oleh sebab itu, maka anak harus tumbuh dan berkembang dengan baik. Salah satu caranya diberikan arahan-arahan yang sifatnya membina demi kelangsungkan hidup lebih lanjut, pembentukan mental, dan memberikan perlindungan berbagai aspek yang memungkinkan akan membahayakan pertumbuhan dan perkembangan fisik serta mental. Pada masa pertumbuhannya, anak bisa tersandung dalam kasus tindak pidana sebagaimana dalam penelitian ini, anak melakukan tindak pidana pencabulan anak. Anak yang diduga melakukan tindak pidana dalam hal ini disebut sebagai Anak Berkonflik dengan Hukum. Berdasarkan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (UU SPPA), Anak yang Berkonflik dengan Hukum yang selanjutnya disebut sebagai Anak adalah anak yang telah berumur 12 tahun, tetapi belum berumur 18 tahun yang diduga melakukan tindak pidana. Rumusan masalah dalam penelitian ini adalah bagaimana perlindungan hukum terhadap anak pelaku tindak pidana pencabulan anak. Dalam UU SPPA diatur tentang diversi, sebagaimana dalam Pasal 1 angka 7, bahwa diversi adalah pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses diluar peradilan pidana. Diversi merupakan salah satu upaya pemerintah untuk memberikan perlindungan hukum terhadap Anak. Jenis penelitian yang digunakan adalah penelitian hukum normatif. Metode pendekatan dalam penelitian ini adalah pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa belum ada perlindungan hukum terhadap anak yang melakukan tindak pidana pencabulan anak, karena dijatuhi hukuman 10 bulan penjara dan pelatihan kerja selama 1 bulan dengan waktu 2 jam perhari. Oleh karena itu disarankan agar anak dapat tumbuh kembang dengan baik seyogyanya tidak dijatuhi hukuman seberat itu, tetapi berpedoman pada asas kepentingan terbaik bagi anak (the best interest of the child) sesuai ketentuan Konvensi Hak Anak dan UU Perlindungan Anak.
