Abstract

With the development and progress of the times at this time also develops a variety of patterns and human behavior does not rule out the possibility of many crimes happening anywhere. Rape is a crime that is very cruel, immoral, despicable and violates the norm in which the victims are women both adults and minors. Legal protection is the most important thing in the elements of a rule of law, because legal protection is the right of every citizen and the obligation of the state as the organizer of the protection. The state provides protection by regulating it in various laws. Then how about legal protection for children from the results of rape. Then the problem under study is the responsibility of the state for the legal protection of children from rape. Based on studies with normative juridical research that the legal protection of children resulting from rape is in accordance with the Child Protection Act. Where in this case the state must carry out child rights-based budgeting planning. Such understanding is so that the state can carry out its responsibilities properly. The state is expected to make additional specific legislation regarding the position of legal protection for children from rape and child rights-based budgeting.
